Terms and Conditions

1. Scope

1.1 These General Terms and Conditions (T&C) apply exclusively to the business relationship between Elite Garage Zuzwil AG (hereinafter referred to as the “Seller”) and the customer (hereinafter referred to as the “Customer”) in the version valid at the time of the order.

1.3 A consumer within the meaning of these T&C is any natural or legal person who enters into a legal transaction (§ 13 BGB).

1.4 Deviating terms of the Customer shall not be recognized unless the Seller expressly agrees to their validity in writing.

2. Offers and Service Descriptions

2.1 The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order. Service descriptions in catalogs and on the Seller’s websites do not constitute a guarantee or assurance.

3. Prices

3.1 All prices stated on the Seller’s website include the applicable statutory value-added tax.

4. Payment Terms

4.1 The Customer may choose from the available payment methods during and before completing the order process.

4.2 If payment by invoice is available, payment must be made within 30 days after receipt of the goods and invoice. For all other payment methods, payment must be made in advance without deduction.

4.3 If third-party providers are used for payment processing (e.g., PayPal), their respective terms and conditions apply.

4.4 If the payment due date is determined by calendar, the Customer shall be in default upon missing the deadline. In this case, the Customer shall pay default interest at a rate of 5 percentage points above the base interest rate.

4.5 The obligation to pay default interest does not exclude the assertion of further damages caused by default.

4.6 The Customer may only offset claims if these have been legally established or recognized by the Seller. A right of retention may only be exercised insofar as claims arise from the same contractual relationship.

5. Retention of Title

5.1 The delivered goods remain the property of the Seller until full payment has been made.

6. Warranty and Guarantee

6.1 Warranty is governed by statutory provisions.

6.2 A guarantee for the goods delivered by the Seller exists only if it has been expressly granted.

7. Liability

7.1 The following exclusions and limitations of liability shall apply to claims for damages, without prejudice to other statutory requirements.

7.2 The Seller shall be liable without limitation where the cause of damage is based on intent or gross negligence.

7.3 The Seller shall also be liable for slightly negligent breaches of essential contractual obligations (cardinal obligations), but only for the foreseeable, typical damage.

7.4 The above limitations shall not apply to injury to life, body, or health, in the case of assumed guarantees, or fraudulent concealment of defects. Liability under product liability law remains unaffected.

7.5 Where liability is excluded or limited, this also applies to employees, representatives, and agents of the Seller.

8. Right of Withdrawal

8.1 No right of withdrawal applies, as the product has been inspected and paid for on-site.

9. Storage of Contract Text

9.1 The Seller stores the contract text. The T&C are available online. The Customer can print the contract text before submitting the order using the browser’s print function.

9.2 The Seller also sends an order confirmation containing all order data to the Customer’s provided email address. A copy of the T&C is included.

10. Jurisdiction, Applicable Law, Language

10.1 Place of jurisdiction and performance is the Seller’s registered office if the Customer is a merchant, a legal entity under public law, or a special fund under public law.

10.2 Swiss law shall apply, unless mandatory consumer protection provisions oppose this.

10.3 The contract language is German.
